Can DVC Members Rent Their Points Every Year?

It’s a little complicated but it all comes down to following the rules in the Disney Vacation Club (DVC) contract.
Is it Ok to Rent DVC Points Every Year?
It really depends and we’ll go over a few different specific instances below that help provide more context.

“Q: As a Disney Vacation Club Member, can I rent my Vacation Points?
A: Members may rent their Vacation Points. However, the use of your Vacation Points for commercial purposes is expressly prohibited. Commercial purpose includes a pattern of rental activity or other occupancy by a Member that the Board of Condominium Association, in its reasonable discretion, could conclude constitutes a commercial enterprise or practice.”
A Disney Vacation Club contract can not be used as “a commercial enterprise or practice.”
The most obvious misuse would be never using your points and only renting them out.
Things start to get tricky beyond that.
The main reason being that the rules are not completely clear.
“Patterns of rental activity” could mean many different things to different people. Is that renting points annually? Every few years? All of your points? A large percentage of your points? It’s up to the DVC Board of Condominium Association to decide.
What if You Can’t Use Your Points for a Few Years?
Sure, there may be some instance of hardship, something important demanding your time or some other reason you’re not able to use your points for the foreseeable, or bank-able, future.
For example, let’s say you’re moving cross country this year and next year you have a big Europe trip planned. Both years you know you won’t be able to use your points. With how your schedule is, banking doesn’t make sense. However, renting does. You decide to rent them out. You have specific reasons for this time period of renting DVC points. Time, or vacation, constraints that don’t allow you to book DVC stays. Clearly this is personal, not commercial.
Renting DVC points in general is permitted or DVC Rental Store wouldn’t exist. These are some places it makes sense.

Someone purchased 150 points at Saratoga Springs to join and be eligible for Membership Extras. Maybe this resort no longer having the luxurious spa changes where they like to stay or how long they like to stay. This changes how they use their points, leaving them with an excess. Sometimes it makes sense to bank points. Sometimes it doesn’t. If you’re in a situation like this and like going to Disney, it may not make sense financially to sell your DVC contract and buy a new one to adjust to your needs. Maybe renting some DVC points out each year until something changes is what works for you.

Using your contract efficiently sometimes means adjusting a trip by a day so that the point spend makes sense with the amount of points you own.
